1. General Provisions

1.1 These terms and conditions for using the Gift Card apply to any Purchaser and any User of the Gift Card. By acquiring and/or using the Gift Card, you agree to these terms and conditions.

1.2 These terms and conditions are available at the point of sale and online at www.westgate.hr.

1.3 These terms and conditions, as well as prices and additional fees, may be subject to change at any time. The applicable terms are those in effect on the date the Gift Card is acquired.

1.4 Any inquiries regarding the Gift Card can be sent via email to: informacije@westgate.hr.

1.5 A “Gift Card” refers to a prepaid card product offered under these terms and conditions.

1.6 The “Issuer” of the Gift Card is Westgate City d.o.o., OIB: 57136792631, with registered office at Zaprešićka ulica 2, Jablanovec, Zaprešić 10290, Croatia.

1.7 The “Card Service Provider” is Giftify S.A., Cantersteen 47, 1000 Brussels, Belgium.

1.8 The “Purchaser” is the contracting party who acquires the Gift Card from the Issuer.

1.9 The “Card User” is the individual who uses the Gift Card at participating Stores.

1.10 “Stores” refer to business locations within the Issuer’s premises that provide services to Gift Card Users and are authorized to accept the card.

1.11 The Gift Card is not considered electronic money under Article 4 of the Electronic Money Act or Article 3 of Directive (EU) 2015/2366 and is not subject to those provisions. Refunds are not possible.

2. Acquiring the Gift Card

2.1 The card is issued and acquired exclusively in EUR.

2.2 It can be purchased by individuals or legal entities, via cashless (card) payment at the point of sale within the Issuer’s premises.

2.3 For orders over EUR 1,000, bank transfer is possible with in-person pickup.

2.4 Activation is only possible at the Issuer’s point of sale.

2.5 The Issuer may refuse to issue a card without explanation.

3. Validity of the Gift Card

3.1 Validity starts on the date of purchase and lasts for 12 months.

3.2 After expiration, the remaining balance is forfeited and cannot be refunded.

4. Use of the Gift Card

4.1 The card can only be used in participating Stores located within the Issuer’s premises.

4.2 Transactions must be made in the presence of the Purchaser or User.

4.3 Not all Stores are guaranteed to accept the card – prior confirmation is recommended.

4.4 The balance is reduced with each purchase.

4.4.1 If the balance is insufficient, the remaining amount can be paid using another payment method (if accepted by the Store).

4.4.2 If the total exceeds the available balance, the transaction will be declined.

4.5 The card cannot be reloaded.

4.6 The card is not a debit card, is not linked to a bank account, and does not accrue interest.

4.7 The card cannot be used for:

4.7.1 pre-authorized recurring payments,

4.7.2 transactions outside the Issuer’s premises,

4.7.3 online transactions,

4.7.4 cash transactions, including withdrawals, checks, or foreign currency exchanges.

4.8 It cannot be used where online authorization is not available.

4.9 The Issuer is not responsible for product quality or exchanges – these are subject to each Store’s policy.

4.10 Resale of the card is not permitted.

4.11 The Issuer is not liable for lost or stolen cards.

4.12 Damaged cards cannot be replaced.

4.13 The Issuer may block or cancel a card due to:

4.13.1 security concerns,

4.13.2 suspected misuse,

4.13.3 violation of these terms.

4.14 In such cases, the Purchaser will be notified in advance where possible and lawful.

5. Payments

5.1 A transaction is considered authorized once the card is swiped or relevant data is provided to the Store.

5.2 An authorized transaction cannot be reversed.

5.3 A transaction may be declined if:

5.3.1 it exceeds the available balance,

5.3.2 it violates payment system rules,

5.3.3 there are legal or security concerns.

5.4 The Issuer is not liable for transaction failures due to force majeure or technical issues.

5.5 Refunds may take up to 10 business days.

6. Balance Check

Available balance, transaction history, and expiration date can be checked via:

• xxxx.westgate.giftify.me,
• the Issuer’s information desk,
• QR code on the back of the card.

7. Privacy

In the event of personal data collection, the Issuer will take all necessary protection measures. Data is processed in accordance with Regulation (EU) 2016/679. More information is available in the Privacy Policy at www.westgate.hr.

8. Fees and Limitations

Card purchase: Free of charge (a fee may apply depending on the sales channel)

Card loading: Free of charge (bank fees may apply)
