GENERAL TERMS OF USE WESTGATE GIFT CARD

General Provisions

Westgate City d.o.o., Zaprešićka 2, Jablanovec, PIN 57163792631 (hereinafter: Issuer) issues a gift card "Westgate gift card" (hereinafter: Card) that can be used for non-cash payments in certain stores and other business premises of the Westgate Shopping Center.

A Card user is any individual or legal person who purchases or otherwise acquires the right to use the Card.

Terms of sale

The card is sold at the information desk of the Westgate Shopping Center.

Permitted means of payment Cards are cash, credit and debit cards, and transactional payment. The currency of payment is always EUR.

The card issuer does not charge a fee for issuing the Card or any other fee. The price of the Card is also the value of the Card.

Card user

The card is issued to the bearer and it cannot be issued to the name. The card is transferable to third parties without restrictions. When transferring the Card, the transferor is obliged to hand over to the Card acquirer these General Terms and Conditions and confirmation of issuance and activation of the Card.

The issuer of the card is authorized at any time, without special notification and without delay, and without compensation to the User, to limit the possibility of using the gift card in a certain shop or branch.

Using the Card

The card can be used as a means of payment only in stores and other branches within the Westgate Shopping Center. Cards are not a permitted means of payment in all shops and branches. The exact list of shops and other branches that accept the Card can be found at the info desk and on the website www.westgate.hr.

Each Card comes with a predetermined limit determined by the Issuer. It is not possible to change the limits on the issued Card. The limit is determined in euros and represents the monetary expression of the maximum consumption per issued Card. By using the Card, the maximum available limit per card is reduced to an amount equal to the purchase invoice at the point of sale.

It is not possible to pay in installments with the card.

The Card can be used multiple times and within a maximum period of 12 months from the purchase (so-called activation) of the Card.

Loss and damage of the Card

The Card user bears the risk of loss and damage to the Card, including damage to the magnetic stripe.

Each Card, when handed over to the User, goes through the so-called activation procedure, which checks its correctness. In the event of damage, destruction, or loss of the Card, there is no obligation on the part of the Issuer to issue a replacement Card, nor is the Issuer under any obligation to the User regarding compensation for damage caused by the loss or damage of the Card.

Replacement and return of the Card

Once issued, the Card cannot be exchanged for money.

Subsequent complaints will not be accepted, as well as requests for refunds after the Card has already been sold.

Disclaimer

The Issuer is not responsible for the material and legal defects of the purchased products and services and the delivery of products and services paid for with the Card, nor is it responsible for the truthfulness of the information obtained when paying with the Card at points of sale.

Final Provisions

These General Terms and Conditions must be kept together with the confirmation of issuance and activation of the Card as long as there are unspent funds on the Card.

The company Westgate City d.o.o. adopted these General Terms and Conditions on February 1st, 2023, and they apply to all Cards sold after February 15th, 2023.
